Acceptance of terms

By accessing or using the Wishly website (wishly.au) and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms are governed by the laws of Victoria, Australia.

Our service

Wishly is an online marketplace that enables you to purchase gift cards, experience vouchers and other gifts from third-party brands, and to deliver them digitally to yourself or others. Wishly acts as seller of the gift card but the underlying product is issued and fulfilled by the respective brand.

Wishly is not affiliated with, endorsed by, or connected to any of the brands listed on our platform. All redemptions occur directly with the issuing brand under that brand's own terms and conditions.

Purchases and payments

All prices are in Australian dollars (AUD) and are inclusive of GST where applicable. Payment is processed securely by Stripe. By completing a purchase you authorise Wishly to charge the stated amount to your nominated payment method.

Orders are generally delivered digitally within seconds of payment confirmation. For same-day physical deliveries (flowers), delivery windows are stated at checkout and subject to availability.

Gift cards

Validity: Gift cards purchased through Wishly are valid for three (3) years from the date of purchase, unless a different period is specified by the issuing brand.

Non-refundable: Once a gift card has been issued and delivered, it cannot be refunded or exchanged for cash, except as required by Australian Consumer Law.

Lost or stolen: Wishly is not responsible for lost, stolen or expired gift card codes once they have been delivered to the recipient. Please treat your gift card code like cash.

Redemption: Gift cards are redeemed directly with the issuing brand. Wishly has no control over the terms, availability or restrictions applied by the brand at the point of redemption.

Refunds

We comply with Australian Consumer Law. If a gift card cannot be redeemed due to a fault on Wishly's part (e.g. an invalid code we issued), contact us at hello@wishly.au and we will issue a replacement or refund.

If the issuing brand has ceased trading or is otherwise unable to honour a gift card, we will work with you to resolve the matter.

Refunds are not available where you simply change your mind, subject to any rights under Australian Consumer Law.

User accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@wishly.au if you suspect unauthorised access.

You must be at least 18 years old to create an account and purchase gifts on Wishly.

Prohibited use

You agree not to use Wishly for any unlawful purpose, to purchase gift cards for fraudulent resale, to use automated tools to scrape or abuse our platform, or to otherwise interfere with our services.

Intellectual property

All content on wishly.au — including logos, text, images and software — is owned by or licensed to Wishly and is protected by Australian and international copyright law. You may not reproduce or distribute any content without our written permission.

Limitation of liability

To the extent permitted by law, Wishly's liability for any claim arising out of these terms or use of our services is limited to the amount you paid for the relevant gift card. We are not liable for indirect, consequential or economic loss.

Nothing in these terms excludes or limits rights you have under the Australian Consumer Law that cannot be excluded or limited.
